Welcome to Atomic Labs (the "Site," "we," "us," or "our"), accessible at https://www.atomic-labs.top (the "Service"). The Service includes our real-time chat functionality (powered by CodyChat) and our discussion forums (powered by XenForo), together with all related features, content, and services offered by us.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "User," or "Member") and Atomic Labs ("Company," "we," "us," or "our"). By accessing, registering for, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.
1. Eligibility
1.1. You must be at least thirteen (13) years of age to create an account, access, or otherwise use the Service. By using the Service, you represent and warrant that you meet this minimum age requirement.
1.2. If you are between the ages of thirteen (13) and the age of legal majority in your jurisdiction of residence, you represent that you have obtained the consent of a parent or legal guardian to use the Service, where such consent is required by applicable law.
1.3. We do not knowingly permit registration by, or knowingly collect personal data from, individuals under the age of thirteen (13). If we become aware that a user under the age of thirteen (13) has provided us with personal data, we will take reasonable steps to delete such data and terminate the associated account without notice.
1.4. We reserve the right to request proof of age at any time and to suspend or terminate any account where we reasonably believe the eligibility requirements of this Section 1 have not been met.
2. Disclaimer of Liability
2.1. No Warranties. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the Service will be uninterrupted, secure, timely, or error-free, or that any defects will be corrected.
2.2. User-Generated Content. The Service allows users to post, transmit, and share content, including but not limited to chat messages, forum posts, images, links, and profile information ("User Content"). We do not endorse, verify, or guarantee the accuracy, reliability, legality, or appropriateness of any User Content, and we are not responsible for any loss or damage arising from your reliance on such content.
2.3. Limitation of Liability. To the fullest extent permitted by applicable law, the Site, its owner(s), operators, administrators, moderators, employees, contractors, partners, affiliates, licensors, and agents (collectively, the "Released Parties") shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, use, or other intangible losses, arising out of or in connection with:
- (a) your access to, use of, or inability to access or use the Service;
- (b) any conduct or content of any third party on or in connection with the Service, including any defamatory, offensive, or unlawful conduct of other users;
- (c) any content obtained from the Service;
- (d) unauthorized access to, use of, or alteration of your transmissions or content;
- (e) any interruption, suspension, or termination of the Service; or
- (f) any technical malfunction, error, delay, or loss of data, however caused.
This limitation applies regardless of the legal theory on which a claim is based (contract, tort, negligence, strict liability, or otherwise) and regardless of whether the Released Parties have been advised of the possibility of such damages.
2.4. Jurisdictional Limitations. Some jurisdictions do not permit the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the exclusions and limitations set forth in this Section 2 shall apply only to the maximum extent permitted by applicable law, and the liability of the Released Parties shall be limited to the smallest extent permitted by law.
2.5. Indemnification. You agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.
3. User Conduct
3.1. By using the Service, you agree to conduct yourself in a manner that is respectful, ethical, and considerate of other users at all times. Without limiting the generality of the foregoing, you agree that you will:
- (a) treat other users with courtesy and respect, in both public and private communications;
- (b) engage in good faith and constructive participation within chat rooms and forum discussions;
- (c) comply with all applicable local, national, and international laws and regulations;
- (d) respect the authority of Site administrators and moderators and comply with their reasonable instructions;
- (e) use the Service only for its intended lawful purposes.
3.2. You agree that you will not:
- (a) impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity;
- (b) engage in harassment, intimidation, stalking, or targeted abuse of any other user;
- (c) circumvent, disable, or otherwise interfere with security-related features of the Service, or with rate-limiting, moderation, or access-control mechanisms;
- (d) use automated means (bots, scrapers, crawlers) to access the Service without our prior written consent;
- (e) engage in spamming, flooding, or other disruptive behavior within chats or forums;
- (f) create multiple accounts for the purpose of evading a ban, suspension, or moderation action.
3.3. Violation of this Section 3 may result in moderation action up to and including suspension or permanent termination of your account, at our sole discretion, as further described in Section 8.
4. Intellectual Property
4.1. The Service, including its underlying software, source code, design, layout, graphics, logos, trademarks, trade names, text, and all other content created by or on behalf of the Company (excluding User Content), is the exclusive property of the Company and/or its licensors and is protected by copyright, trademark, and other intellectual property laws.
4.2. Except as expressly permitted under these Terms or with our prior written consent, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any part of the Service.
4.3. All trademarks, service marks, and trade names used on the Site, including "Atomic Labs" and its associated logos, are proprietary to the Company. Nothing in these Terms grants you any right or license to use such marks without our prior written authorization.
4.4. Any unauthorized use of the Site's intellectual property may result in civil and/or criminal penalties and will result in immediate termination of your account.
5. Prohibited Content and Conduct
5.1. You agree that you will not post, upload, transmit, link to, or otherwise make available any content that:
- (a) constitutes hate speech, or that promotes discrimination, hostility, or violence against any individual or group on the basis of race, ethnicity, national origin, religion, disability, gender, gender identity, sexual orientation, age, or any other protected characteristic;
- (b) is defamatory, obscene, pornographic, or sexually explicit;
- (c) depicts, describes, promotes, or facilitates the sexual exploitation or abuse of minors in any form. Any such content, or any account found to be engaging in such conduct, will result in immediate and permanent termination of access, preservation of relevant data, and a mandatory report to the National Center for Missing & Exploited Children (NCMEC) and/or the appropriate law enforcement authorities in the applicable jurisdiction, without prior notice to the user;
- (d) constitutes bullying, harassment, threats, or incitement of violence against any individual or group;
- (e) contains malicious code, malware, viruses, or any material designed to disrupt, damage, or gain unauthorized access to any computer system, network, or data ("hacking"), including phishing attempts, credential theft, or exploitation of Site vulnerabilities;
- (f) infringes upon the intellectual property, privacy, or publicity rights of any third party;
- (g) promotes illegal activity, including the sale or distribution of illegal goods, controlled substances, or weapons;
- (h) constitutes spam, unauthorized advertising, or pyramid/multi-level marketing schemes;
- (i) violates any applicable local, national, or international law or regulation.
5.2. We reserve the right, but not the obligation, to monitor, review, remove, or restrict access to any content at our sole discretion, and to cooperate fully with law enforcement authorities or court orders requesting or directing us to disclose the identity, data, or content of anyone posting content that violates this Section 5.
5.3. Where required by applicable law, we will report content described in Section 5.1(c) to the relevant statutory authority, including but not limited to NCMEC in the United States or equivalent bodies in other jurisdictions.
6. Data Usage
6.1. We collect and process certain data relating to your use of the Service, including technical and behavioral data, for purposes of maintaining, securing, and improving the Service, diagnosing technical issues, personalizing user experience, and developing new features.
6.2. A full description of the categories of data we collect, and the purposes for which such data is processed, is set forth in our Privacy Policy, which forms an integral part of these Terms.
7. Content Ownership and License Grant
7.1. As between you and the Company, you retain ownership of the intellectual property rights in the User Content you submit to the Service, to the extent such rights exist and subject to applicable law.
7.2. By submitting, posting, or displaying User Content on or through the Service, you grant to the Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, create derivative works from, distribute, publicly display, publicly perform, and otherwise exploit such User Content in connection with operating, providing, promoting, and improving the Service, in any media formats and through any media channels now known or hereafter developed.
7.3. This license survives termination of your account solely with respect to User Content that remains stored, cached, or otherwise retained by the Service or shared by other users, and continues for so long as reasonably necessary for the purposes described in Section 7.2 or as required by law.
7.4. You represent and warrant that you own or have obtained all necessary rights, licenses, consents, and permissions to submit your User Content and to grant the license set forth in this Section 7, and that such User Content does not infringe or violate the rights of any third party.
8. Termination
8.1. We reserve the right, at our sole discretion and without prior notice, to suspend, restrict, or permanently terminate your access to the Service, in whole or in part, for any violation of these Terms, any conduct that we deem harmful to the Service or its users, or for any other reason we deem appropriate, including at our sole business discretion.
8.2. You may terminate your account at any time by following the account deletion procedures made available within the Service or by contacting us as described in Section 10.
8.3. Upon termination, your right to access and use the Service will immediately cease. Sections 2 (Disclaimer of Liability), 4 (Intellectual Property), 7 (Content Ownership), and any other provision which by its nature should survive termination, will survive any termination of these Terms.
9. Changes to These Terms
9.1. We reserve the right to modify, amend, or update these Terms at any time, at our sole discretion. Where changes are material, we will endeavor to provide reasonable notice, such as by posting a notice on the Site or updating the "Last Updated" date above.
9.2. Your continued access to or use of the Service following the posting of any changes to these Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, your sole remedy is to discontinue use of the Service.
